Welcome to Pixel Pump Club. The terms "we", "us" and "our" refer to Pixel Pump Club. We operate this store and website (including all content, features, tools, products, and services) to give you a curated shopping experience (the "Services"). Pixel Pump Club is powered by Shopify.

The terms below describe your rights and responsibilities when you use our Services. They include important information about warranty disclaimers and limitations of liability. Read them. They matter.

By visiting, interacting with, or using our Services, you agree to these Terms of Service and our Privacy Policy. If you don't agree, don't use the Services. Simple.

To use the Services (including browsing, purchasing, or creating an account), you may need to provide your email address, billing, payment, and shipping information. You represent that all information you provide is accurate, current, and complete, and that you have the rights to provide it.

SECTION 2  OUR PRODUCTS

We do our best to represent our products accurately. That said, colors and product appearance may vary based on your screen and device settings. We don't warrant that any product will look exactly as shown or meet every expectation. Screens lie sometimes.

Product descriptions are subject to change at any time without notice. We reserve the right to discontinue any product and may limit quantities per person, region, or jurisdiction.

SECTION 3  ORDERS

When you place an order, you're making an offer to purchase. Pixel Pump Club reserves the right to accept or decline any order for any reason. Your order is not confirmed until we accept it. We need to receive and process your payment first.

Review your order carefully before submitting. We may not be able to accommodate cancellations once an order is accepted. If we decline, modify, or cancel your order, we'll reach out using the contact info you provided.

Returns and exchanges are handled in accordance with our Refund Policy. Your purchases are for personal or household use. Not for commercial resale or export.

SECTION 4  PRICES AND BILLING

Prices, discounts, and promotions can change without notice. The price you're charged is the price at the time you place your order, confirmed in your order email. Unless stated otherwise, posted prices don't include taxes, shipping, handling, customs, or import charges.

Store prices may differ from third-party platforms. Promotions have their own terms. If there is a conflict, the promotion terms win.

You agree to provide accurate, current payment information and to keep it updated. You confirm that your card is valid, you're authorized to use it, and you'll pay all charges including applicable taxes and fees.

SECTION 5  SHIPPING AND DELIVERY

Delivery times are estimates, not guarantees. We're not liable for delays caused by carriers, customs, or events outside our control. Once your order is handed off to the carrier, title and risk of loss pass to you.

SECTION 6  INTELLECTUAL PROPERTY

Everything on our Services, including trademarks, text, graphics, images, product designs, video, audio, is owned by Pixel Pump Club, our affiliates, or licensors, and is protected by U.S. and international intellectual property law.

You may use the Services for personal, non-commercial purposes only. You may not reproduce, distribute, modify, or transmit any material without our prior written consent. Pixel Pump Club's name, logos, and product names are our trademarks. Don't use them without permission. Same goes for Shopify's marks.

SECTION 7  OPTIONAL TOOLS

We may provide access to third-party tools as part of the Services. These tools are provided as-is. We do not monitor or control them, and we make no warranties about them. Use them at your own discretion and risk.

SECTION 8  THIRD-PARTY LINKS

Our Services may link to third-party websites. We're not responsible for their content, accuracy, or practices. If you leave our site, you do so at your own risk. Complaints about third-party products or services go to those third parties directly.

SECTION 9  RELATIONSHIP WITH SHOPIFY

Pixel Pump Club is powered by Shopify, but all transactions are made directly with us, not Shopify. By using the Services, you acknowledge that Shopify is not responsible for any aspect of your purchase, including any injury, damage, or loss from products. You release Shopify and its affiliates from any claims arising from your transactions with Pixel Pump Club.

SECTION 10  PRIVACY POLICY

All personal information collected through the Services is subject to our Privacy Policy [link to Privacy Policy] and, where applicable, Shopify's Privacy Policy. By using the Services, you've read and acknowledged both. Information you submit may be shared with Shopify and their partners to provide services to you.

If you send us ideas, suggestions, reviews, or feedback, you grant Pixel Pump Club a perpetual, worldwide, royalty-free license to use, reproduce, modify, and distribute that content for any purpose, including improving and promoting our Services.

You confirm that you own or have rights to the feedback you send, that it's accurate, and that it complies with these Terms. We're not obligated to keep your feedback confidential, compensate you for it, or respond to it. We may monitor and remove feedback that violates these Terms.

Occasionally, information on the Services may contain typographical errors, inaccuracies, or omissions. We reserve the right to correct any errors and update or cancel orders without prior notice, even after an order has been submitted.

Information on the Services is for general informational purposes. We don't warrant its accuracy, completeness, or usefulness. Any reliance you place on it is at your own risk.

SECTION 16  LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PROVIDED BY LAW, PIXEL PUMP CLUB, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, LICENSORS, AND THOSE OF SHOPIFY AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, OR REPLACEMENT COSTS, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS PURCHASED THROUGH THEM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

SECTION 17  INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Pixel Pump Club, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, or claims, including reasonable attorney fees, arising from: (1) your breach of these Terms; (2) your violation of any law or the rights of a third party; or (3) your access to and use of the Services.

We'll notify you of any indemnifiable claim and may control the defense and settlement at your expense. You agree to cooperate in the defense of such claims.

SECTION 18  SEVERABILITY

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will continue in full force and effect.

SECTION 19  WAIVER AND ENTIRE AGREEMENT

Our failure to enforce any right or provision of these Terms doesn't constitute a waiver of that right. These Terms, along with any policies posted on our site, represent the entire agreement between you and Pixel Pump Club and supersede all prior agreements.

SECTION 20  ASSIGNMENT

You may not transfer or assign this Agreement or any of your rights under it without our prior written consent. Any attempt to do so is void. We may transfer or assign these Terms and our rights without notice.

SECTION 21  GOVERNING LAW

These Terms are governed by the laws of the jurisdiction where Pixel Pump Club is headquartered. You consent to venue and personal jurisdiction in those courts.

Section headings are for convenience only. They don't limit or otherwise affect these Terms.

SECTION 23  CHANGES TO TERMS OF SERVICE

We may update these Terms at any time. The most current version will always be available on this page. We'll notify you of material changes as required by applicable law. Your continued use of the Services after changes are posted means you accept the new Terms.
